General sales conditions

The general sales condition of this website are governed by Italian law and in particular by Legislative Decree 70/2003 regarding electronic commerce and by Legislative Decree 206/2005 with specific reference to the legislation on distance contracts.

All prices are VAT excluded. All sales made in the EU to business customers, will be made in VAT exempt.

Even if photos almost always correspond to the product on sale, they are for illustrative purposes only and therefore non-binding. At the end of the order, if the goods must be shipped, shipping costs will be calculated and may vary depending on the destination of the goods, weigh /volume, order amount and type of payment.

As soon as you finish the order correctly you will receive an email from the system that will confirm the products purchased. At the unquestionable judgment of the seller, orders may also be rejected. All items for sale are ex-our warehouses. The goods sold are always new from the factory. In the case of out-of-print items, the customer will be promptly notified with a proposal for partial supply or alternative article offer. In the event of force majeure, or unforeseeable circumstances, we will not be liable for any delays or non-delivery of the goods and we will also have the right to terminate the whole or part of the contract, suspend or delay its execution.

The ordered goods, if available in stock, will be sent the working day that follow the receipt of the order upon verification of the occurred payment. For products that require preparation, design, assembly or special transport, the shipping time will be variable and will always be specified in the product sheet.

Prices, configurations, technical and aesthetic characteristics of the products on sale, can be modified at any time, as a result of market variations or editorial errors.

PAYMENT METHODS:

Bank Transfer:
To be done to your bank before shipping using the coordinates that will be communicated on the last checkout page and in the order confirmation email.
Credit Card or PayPal:
VISA, Master Card, VISA electron, American Express and PayPal cards are accepted. The holders of a PayPal account can also pay with the funds of their account by accessing in it directly during the check out. (To do this it is necessary that once you get to the payment screen proposed by PayPal, put where is required the access data of your account). Purchased in total security, virtual payment systems are guaranteed by state-of-the-art technologies. The security of the transaction is guaranteed by the fact that the customer, during the payment transactions is automatically directed to the PayPal site that is hosted on a secure server (https: //). We communicate to PayPal only the order number and the amount that the customer must pay. The customer communicates his sensitive data only to PayPal, with SSL encrypted 128 bit (billions of combinations). If the payment is successful, the result will be communicated by e-mail to both the customer and the seller. Depending on the response received, the seller records the movement charged to the customer and provides to process the order. These operations take place within a few seconds, so you know immediately if the payment was successful.

Pay attention...! All orders paid by bank transfer will be processed only when payment is received and the amount will be credited to our bank account.

WARRANTY:

Warranty covers only manufacturing defects. The same decade if: the damage is caused by accident, bad use of the product, acts of vandalism, fire, water, natural events or exposure to very high temperatures, dust, excessive humidity, poor storage or if the product will undergo technical changes that are not made by our staff or inadequate use even in conjunction with other equipment. In case of malfunction or breakdown of any component of the product, you must send an email to service@labelshop-europe.comwhich contains: copy of the purchase document, indication of the defective product and its description of the defect, in the clearest and most detailed way possible.
 After receiving your communication, you will be contacted as soon as possible by one of our managers who will provide you all the information useful and necessary to take advantage of the warranty. Any faulty product will be repaired free or replaced with the same or equivalent product and it will be returned in working order and in a short time. In the case of replacement, the returned unit will benefit of the remaining warranty period. In the event that the product is irreparable or obsolete, you will be issued credit note and reimbursed the cost of the product to the exclusion of additional costs incurred, or alternatively, you will be offered a voucher of the value of the irreparable product to spend on this site to the purchase of an alternative article.
In case of shipment of the goods to our laboratories, the same must be sent in free port so that the transport costs will be borne by the sender except in cases where the customer is authorized to ship to the assigned port. Shipments carried out in port assigned without authorization and therefore with transport costs borne by the recipient, will not be accepted and will be rejected to the sender. The products must arrive in the original packaging as at the time of purchase, complete with any accessory (cables, software, manuals, boxes, electrostatic bags, etc.). Products not properly packaged or not complete with accessories will not be covered by warranty.
In the case of a product that has not been broken and therefore normally functioning, the product will be sent back to the customer in assigned port and the logistics and failure search costs incurred will be charged.

RIGHT OF WITHDRAWAL:

According to European laws, the customer can withdraw from the contract of sale without any penalty and without specifying the reasons within ten days with effects from the day of receipt for the goods and from the day of conclusion of the contract for services. You can exercise your right of withdrawal  by sending a request via email to the address service@labelshop-europe.com.

In case of withdrawal:
The costumer must sent back to the sender the goods purchased subject to withdrawal within ten days from the date of receipt by postal service or by express courier in free port, and so with transport costs against him. The goods must be returned intact in all its parts and in the original packaging (necessary condition, otherwise it will be refused) together with any delivery documents or accompanying goods attached to the product.

Reimburse of the fee:
The seller will reimburse the cost of the goods only, excluding shipping costs, by PayPal within a strict period and within thirty days of receipt of the goods for which the consumer has expressed a willingness to exercise the right of withdrawal. It is understood that the costs for returning the item object of the recess, are at the expense of the consumer.

Exclusion of the right of withdrawal

The right of withdrawal cannot be exercised in the following cases:

• provision of services whose execution has begun, with the consent of the consumer, before the expiry of the deadline;
• provision of goods or services whose price is linked to fluctuations in the rates of the financial market that the seller is not able to control;
• provision of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly;
• provision of sealed audio-visual products or computer software, opened by the consumer and not closable;
• provision of newspaper, periodicals and magazines;
• betting and lottery services (Article 55, paragraph 2), vices.

“DIMATICA s.r.l.” later named “DIMATICA”, as "Data Controller" of the treatment, guarantees the utmost confidentiality of the personal data of the Customer and the full respect with the obligations established by the GDPR EU Regulation 2016/679. In this virtue, he informs consumers that the data of which DIMATICA becomes aware, will also be processed with computerized systems and, with the help of third party, connected to the company organization, exclusively for purposes related to the execution of the contract. JURISDICTION:

For any disputes or legal problems, the Italian court of Nola (NA) is the exclusively competent jurisdiction.
